What is a Living Will?

The legal status of a Living Will in Scotland often causes confusion and uncertainty. Living Wills are not legally binding.

However, they do provide an indication of the wishes of an individual who may be terminally ill or dying. A Living Will is a document which can set out your wishes relating to matters such as your care during the latter parts of your life, the opportunity to convey wishes if someone is unable to communicate effectively and potentially to avoid family conflict in the future. Clients sometimes ask whether particular medical treatment can properly be outlined in a Living Will. However, any specific requests for medical treatment is not enforceable by way of a Living Will.
