Wills

McIntyre & Company offer a complete range of legal services in relation to the preparation of Wills, rights of succession, potential inheritance tax liability on death, and many other related matters. We will be happy to provide you with general advice on such matters and to take your instructions for the preparation of your new will. In some circumstances it may not prove necessary to prepare a new will as minor alterations to an existing will can often be achieved by way of a simple Codicil attached to your existing Will.

At the initial meeting, we can also provide you with a fee quotation covering all work which you may wish us to carry out on your behalf. In the event that you are unable to travel to our office, it may be possible for one of our Solicitors to arrange a home visit with you.

In order to safeguard your assets and the future of your loved ones, it is important that you take steps to prepare a Will. Did you realise that without a Will the following circumstances can arise?:

  • UNMARRIED COUPLES: Even if you have children together your partner may get nothing.
  • MARRIED COUPLES: Many men assume that everything will automatically go to their wives. This is not always so. Children, brothers, sisters and even in-laws may inherit part of your estate.
  • SEPARATED COUPLES: Your separated husband or wife may still be entitled to inherit part of your property or estate.
  • PARENTS: It may be necessary for some circumstances for a Court to appoint Guardians to decide who will bring up your children.
  • SINGLE PEOPLE: Your friends, family and Charities may not benefit in the absence of a Will.
  • EVERYONE: It may be your intention to leave a gift or some money. The only way to ensure that this happens is if you make a Will clearly stating your intentions.

There can be many benefits in speaking with one of our Solicitors who has extensive training in Wills and Executry matters. For example, it may be possible for you to find out:

  • How to ensure that your Will is never lost.
  • The Duties of an Executor.
  • All about obtaining Confirmation of Estate (sometimes referred to as Probate).
  • How to protect your home from being seized to pay for care in your old age.
  • The current law relating to the avoidance of unnecessary suffering from being kept alive against your will.
  • About the advantages of Powers of Attorney for the conduct of some or all of your affairs during your lifetime.
