Buying and Selling a House
Buying and Selling a House
Thinking of buying a new house this year? Alternatively, you may be thinking of selling your house.
Well, whatever your intentions, don’t do anything until you have taken advice from one of our solicitors who will be in a position to provide specialist advice in relation to residential property transactions.
Whether you are buying or selling a house, re-mortgaging, or arranging your personal affairs by having a Will prepared, we can assist you in each of these areas. Buying a house may be the biggest single investment which most people make in life it is very important therefore to have someone you can trust to help you through the whole process to explain all the various steps involved and also to make sure that the transaction proceeds as smoothly and efficiently as possible.
Buying or selling a house can be a thought provoking experience particularly as this may involve eating into a large proportion of your personal savings or committing yourself to repayment of a large mortgage for many years.
If you are buying a house, we will give you the benefit of our extensive experience by advising you on the price which you offer for the property. The Seller of the property (or the Estate Agents) should provide you with a document called a Home Report which is required by law in most residential property sales.
The Home Report provides buyers (and sellers) with better information about the condition and value of properties. The Report is a pack of three documents, namely a Single Survey, an Energy Report and a Property Questionnaire. The Single Survey provides buyers with better information about the condition and value of a property before the buyer makes an offer to purchase. Once you decide how much to offer for the property, we will then prepare and submit a detailed written Offer in suitable legal terms on your behalf and thereafter take steps to complete the purchase as quickly as possible.
If you are selling a house, our trained property staff can help you by providing advice on all aspects relating to the marketing of your property. As indicated above, all sellers who wish to put their house on the market must obtain a Home Report before the property is marketed to provide, upon request, a copy to prospective buyers. There are a number of exceptions to the requirement to provide a Home Report, including new housing, mixed sales and houses that have been converted. However, the vast majority of houses which are advertised for sale on the open market will require a Home Report before the property can be advertised for sale. The costs of the Home Report will require to be met by the seller and this additional cost will require to be factored into the overall costs of selling your home. Your property will be given wide exposure on our Website (solicitors-scotland.com), as well as other online property websites to which we have access. We will also display full property details in our Property Shop.
Our staff will deal with any enquiries from prospective buyers with a view to securing good offers and finalising the sale for you. The Solicitors in our Conveyancing Department have extensive experience in the sale and purchase of properties from the Islands in the North to the border in the South. We undertake the purchase, sale and leasing of most types of residential and commercial property.
We offer a FREE INITIAL MEETING at our office when we can give you advice to make the buying or selling process easier and to try and help you stay one step ahead of the competition.
We can also give you advice and assistance in connection with the buying of a brand new house and about self building. You may be buying a house in need of renovation and before proceeding you may require advice about necessary building consents and/or planning permissions which may be needed.
It is vital that you know the real cost of moving and to assist you in working out the legal expenses we will endeavour to provide, free of charge, a detailed FEE QUOTE for either the sale or purchase of any particular property. We aim to send you a written fee quote and all quotes are applicable and open for acceptance for a maximum period of 30 days.
The more information you provide us with, the more accurate the fee quote is likely to be. You will want to budget for every planned expense in buying or selling a house. We will try to anticipate the likely expenses payable although some expenses imposed by the Government or outside agencies, such as the costs of registering deeds in the Land Register, stamp duty, etc, may increase from time to time and the level of these expenses cannot, therefore, be guaranteed.
Don’t forget about the costs of buying and sending out change-of-address cards and also the costs of drinks and nibbles for your house-warming party!
